Creator Terms

These terms govern music uploaded through Creator Studio. They are designed to keep ownership with the creator while giving the platform the limited rights needed to host, stream, market, and fulfill licenses the creator authorizes.

1. You keep your ownership.

You do not transfer your copyright to McCluster by uploading music. You retain whatever ownership and control you lawfully hold in the master recording, composition, artwork, name, and other submitted material.

2. Limited platform license.

By submitting a release, you grant McCluster Corp a non-exclusive, worldwide license during the time the release is available on the service to store, reproduce for technical delivery, transcode, stream, display, promote, and distribute the submitted material through McCluster-owned services. This includes making temporary or permanent technical copies needed for hosting, playback, previews, downloads, backups, fraud prevention, moderation, and customer fulfillment.

3. Licensing authority.

If you create a license offer, you authorize McCluster to present that offer, collect payment, deliver the licensed asset or entitlement, keep the disclosed platform fee, and account for the creator share. McCluster may refuse, pause, or remove an offer when rights are unclear, disputed, incomplete, or inconsistent with the submitted terms.

4. Your rights warranty.

You promise that the rights information you submit is accurate and that you have the authority needed for the specific uses you enable. This includes master rights, composition/publishing rights, collaborator permissions, featured-performer permissions, samples, interpolations, artwork, and any other protected material included in the release.

5. Parodies, remixes, covers, samples, and derivative works.

Marking a work as a parody or derivative does not automatically clear it for commercial licensing. Those releases remain subject to manual rights review, and McCluster may require additional permission or documentation before publication, download, or paid licensing is enabled.

6. Review and takedown.

Submission does not guarantee publication. McCluster may place a release into review, reject it, suspend it, or remove it when there is a credible rights, fraud, safety, payment, or policy issue. Existing customer licenses and legal recordkeeping obligations may survive a takedown where required.

7. Payments and refunds.

When paid licensing is enabled, the checkout displays the customer price. The platform records the platform fee and creator net separately. Refunds, chargebacks, taxes, payment-processing costs, legal holds, and fraud losses may affect amounts ultimately payable. A creator payout is not considered final until the underlying transaction is settled and no longer restricted.

8. No exclusivity unless separately signed.

Creator Studio license offers are non-exclusive unless McCluster and the creator sign a separate written agreement that expressly states otherwise. Exclusive rights, catalogue acquisition, publishing administration, and ownership transfers are outside these click-through terms.

9. Removal request.

You may request removal of your unpublished or published material. McCluster may retain transaction records, rights attestations, audit records, and copies required to honor existing licenses, resolve disputes, prevent fraud, or comply with law.

10. Contact.

Operational platform terms should be reviewed by qualified counsel before broad commercial rollout, especially for derivative works and multi-party royalty arrangements.
